Agreement to These Terms

Welcome to Servd. These Terms of Service ("Terms") are a legal agreement between you and AspireCore LLC ("we", "us", "our"), the operator of Servd (the "Service"). By creating a Servd account, accessing, or using Servd, you agree to be bound by these Terms and the Servd Privacy Policy.

If you do not agree to these Terms, you may not use Servd. We may update these Terms from time to time; material changes will be surfaced in the Servd app and the "Last updated" date above will change. Continued use of Servd after a change means you accept the updated Terms.

Eligibility

Servd is for adults. You must be at least 18 years old to create a Servd account or use Servd. We ask for your date of birth at sign-up and enforce this requirement at account creation. Servd is not directed to children under 13, and we do not knowingly collect personal information from anyone under 18. This matches the Servd Privacy Policy: the age floor we enforce is 18, not 13.

You must provide accurate account information when registering for Servd and keep it current. You are responsible for all activity that occurs under your Servd account.

Your Servd Account

You are responsible for maintaining the confidentiality of your Servd sign-in credentials. Notify us immediately at the contact below if you suspect any unauthorized use of your account.

We reserve the right to suspend or terminate Servd accounts that violate these Terms, the Servd Community Guidelines, or applicable law.

Subscriptions and Billing

Parts of Servd are offered as optional paid subscriptions that renew automatically. Purchases are made through Apple's App Store or Google Play; the price, renewal period, and any free-trial or introductory terms are shown in the app before you buy. Where the platform so provides, any unused portion of a free trial is forfeited when you purchase a subscription.

Payment is charged to your App Store or Google Play account at confirmation of purchase. A subscription renews automatically — and your app-store account is charged for the next period — unless you cancel at least 24 hours before the current period ends. You can manage or cancel a subscription at any time in your device's subscription settings (App Store: Settings → your name → Subscriptions; Google Play: Menu → Payments & subscriptions). Deleting the app or your Servd account does not by itself cancel a subscription.

Refunds for app-store purchases are handled by Apple or Google under their own policies; we do not process app-store payments and cannot issue those refunds directly.

We may change subscription pricing for future billing periods. If the price of your subscription increases, the app store will notify you and, where it requires it, ask for your consent before the new price applies. If you do not agree, you can cancel before the next renewal takes effect.

User Content

You retain all rights to the photos, captions, reviews, ratings, comments, and other content you submit to Servd ("Your Content"). By submitting Your Content to Servd, you grant AspireCore LLC a worldwide, royalty-free, non-exclusive, sublicensable license to host, store, reproduce, modify (e.g., resize for display), publish, and display Your Content on and through Servd for the purpose of operating and improving the Service.

You represent that you own or have the necessary rights to submit Your Content to Servd and that it does not infringe any third-party rights.

We may remove Your Content from Servd at any time if we reasonably believe it violates these Terms, the Servd Community Guidelines, or any applicable law.

Acceptable Use

You agree not to use Servd to:

• Post content that is unlawful, harassing, defamatory, hateful, sexually explicit, or invasive of another's privacy.
• Impersonate any person or entity, or misrepresent your affiliation with a person or entity, on Servd.
• Upload content to Servd that infringes intellectual property rights you do not own or have permission to use.
• Attempt to gain unauthorized access to Servd, other accounts, or our infrastructure.
• Use Servd to send spam, run unauthorized advertising, or solicit on behalf of unrelated businesses.
• Reverse-engineer, scrape, or systematically extract data from Servd except as expressly permitted by these Terms.
• Use automated tools (bots, scrapers, crawlers) to interact with Servd without our prior written consent.

AI-Generated Content

Servd uses third-party AI models to generate content such as restaurant briefs, dish recommendations, and natural-language search results. AI output in Servd is provided "as is" and may be inaccurate, incomplete, or out-of-date. You should independently verify any factual claim (operating hours, allergen information, prices, dietary suitability) before relying on it for a real-world decision.

We do not represent that AI-generated descriptions in Servd accurately reflect any specific restaurant's current menu, ingredients, or practices.

Reservations and Third-Party Services

Servd may surface availability information from third-party reservation platforms (e.g., Resy, OpenTable) and link out to those platforms for booking. AspireCore LLC does not operate those platforms, does not confirm reservations on your behalf unless explicitly stated within Servd, and is not responsible for any platform's availability, pricing, cancellation policy, or service quality.

Any booking you make on a third-party platform via a Servd link is governed by that platform's terms, not these Terms.

Intellectual Property

Servd, including the "Servd" name, logos, design, features, and underlying software, is owned by AspireCore LLC and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use Servd for personal, non-commercial purposes in accordance with these Terms.

No part of Servd may be reproduced, modified, distributed, or sold without our prior written consent.

Termination

You may stop using Servd and delete your Servd account at any time from the in-app account settings. Upon deletion, your personal information is removed in accordance with the Servd Privacy Policy and Data Deletion Instructions.

We may suspend or terminate your access to Servd at any time, with or without cause, including for violations of these Terms. Sections that by their nature should survive termination (e.g., intellectual property, disclaimers, limitations of liability, governing law) will survive.

Disclaimers

SERVD IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SERVD WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT WITHIN SERVD WILL BE ACCURATE OR RELIABLE.

We make no guarantees about the quality, safety, hygiene, or accuracy of any restaurant or food item described in Servd.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASPIRECORE LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF SERVD.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO SERVD WILL NOT EXCEED THE GREATER OF $50 USD OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.

Indemnification

You agree to defend, indemnify, and hold harmless AspireCore LLC from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to (a) your use of Servd, (b) Your Content, or (c) your violation of these Terms or any law or third-party right.

Governing Law and Disputes

These Terms, and any dispute arising from your use of Servd, are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or Servd will be resolved by binding individual arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules, unless prohibited by your local law.

You and we waive any right to participate in a class action or class-wide arbitration relating to Servd.

Apple App Store Terms

If you downloaded the Servd app from Apple's App Store, you also agree to Apple's Licensed Application End User License Agreement, which is incorporated by reference. Apple is not a party to these Terms but is a third-party beneficiary of them with respect to your use of the Servd app and may enforce them against you. Apple's standard EULA is available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

Changes to These Terms

We may revise these Terms at any time. Material changes will be announced in the Servd app and will update the "Last updated" date above. Your continued use of Servd after a change means you accept the new Terms. If you do not accept a change, you should stop using Servd and delete your account.
